1. Barklen Services

Barklen is a dog training marketplace and business platform.

Barklen services may include:

• A public directory and marketplace for finding dog-training businesses
• Business listings and claimed profiles
• Featured Placement
• Barklen business-management software
• Lead and customer management
• Client and dog records
• Scheduling
• Program management
• Payments
• Communications
• Reviews and follow-up tools
• Business analytics
• Dog Training Business Academy by Barklen
• Newsletters
• Professional communities
• Barklen Video Interviews
• Industry research and resources
• Other products introduced by Barklen

Not every Barklen feature is available in every location, account, or subscription.

2. Barklen Is Not a Dog Trainer

Barklen does not provide dog-training services unless expressly stated otherwise.

Dog-training businesses listed on Barklen are independent businesses.

Unless expressly stated:

• Barklen does not employ listed trainers.
• Barklen is not an agent of a trainer.
• Barklen is not a party to the training agreement between a trainer and dog owner.
• Barklen does not control how trainers perform training services.
• Barklen does not guarantee training results.
• Barklen does not endorse a particular training philosophy or methodology.

Consumers are responsible for evaluating whether a business is appropriate for their needs.

3. Business Listings

Barklen may create business listings using:

• Information supplied by businesses
• Publicly available information
• Business websites
• Public business profiles
• Other lawful sources

The existence of a listing does not mean the business has claimed, verified, endorsed, or partnered with Barklen. Businesses may be permitted to claim listings and update information. Businesses are responsible for ensuring that information they provide is accurate, lawful, and current.

4. Verification, Reviews, and Profile Information

Barklen may offer features that indicate whether certain business information has been claimed, verified, or supplied by the business.

Unless expressly stated otherwise, these features do not constitute a guarantee regarding:

• Training quality
• Safety
• Professional competency
• Business performance
• Results
• Suitability for a particular dog

Reviews and user-generated content represent the opinions of their authors. Barklen may moderate content but does not guarantee the accuracy of every review or listing.

5. Featured Placement

Businesses may purchase Featured Placement or other promotional visibility.

Featured Placement is advertising or enhanced marketplace exposure and does not constitute an endorsement or certification by Barklen.

Featured status does not guarantee:

• Leads
• Sales
• Revenue
• Bookings
• Search ranking outside Barklen
• Any particular volume of consumer activity

Barklen may limit Featured inventory by market, city, category, or other criteria. Where Barklen sells an exclusive Featured position for a geographic market, that exclusivity applies only according to the purchase terms and Barklen's definition of the applicable market.

6. Business Accounts

To use certain Barklen business features, you may need to create an account.

You represent that:

• The information you provide is accurate.
• You are authorized to act for the applicable business.
• You will keep your credentials secure.
• You will promptly update inaccurate information.
• You are responsible for activity occurring through your account.

Barklen may suspend or restrict accounts where we reasonably believe there has been fraud, unauthorized access, misuse, or violation of these Terms.

7. Barklen Business Software

Barklen may provide business-management software designed for dog-training businesses.

Features may include:

• Leads
• Clients
• Dogs
• Programs
• Calendar
• Scheduling
• Booking
• Contracts
• Forms
• Payments
• Training notes
• Homework
• Progress tracking
• Client communication
• Capacity management
• Reviews
• Staff management
• Reports
• Analytics
• Automation

Features may change as the product evolves. Barklen does not guarantee that every feature will remain available indefinitely.

8. Business Customer Data

Businesses retain their rights in information they enter into Barklen concerning their customers, dogs, employees, programs, and operations.

Businesses authorize Barklen to process this information as reasonably necessary to:

• Provide the service
• Store and transmit information
• Provide support
• Maintain security
• Prevent misuse
• Improve the service
• Comply with legal obligations
• Perform activities otherwise permitted by applicable agreements

Businesses are responsible for having appropriate legal rights and permissions to provide customer data to Barklen. Businesses must provide any legally required privacy notices and obtain any legally required permissions from their customers.

9. Payments

Barklen may provide payment functionality using Stripe or another third-party payment processor.

Unless expressly stated otherwise, the dog-training business—not Barklen—is the seller and provider of the underlying dog-training service.

Businesses are responsible for:

• Prices
• Services provided
• Refund policies
• Cancellations
• Customer disputes
• Chargebacks
• Taxes
• Delivery of training services
• Compliance with applicable law

Businesses using Stripe Connect or similar functionality may also be required to agree directly to the payment provider's terms.

10. Barklen Platform Fees

Barklen may charge subscription, advertising, platform, transaction, or other fees as disclosed when a service is purchased or activated.

For Barklen payment functionality, the currently planned Barklen platform fee is 0.75% per transaction, capped at $7.50 per transaction.

Payment-processor fees charged by Stripe or another processor are separate from Barklen's platform fee unless expressly stated otherwise.

Barklen may modify pricing prospectively upon appropriate notice.

11. Subscriptions and Automatic Renewal

Certain Barklen services may be offered as recurring subscriptions.

When you purchase a recurring subscription, the pricing page or checkout will state:

• Subscription price
• Billing interval
• Applicable recurring charges
• Cancellation terms

Unless otherwise stated, recurring subscriptions automatically renew until canceled. You authorize Barklen and its payment provider to charge the applicable payment method for recurring fees. You may cancel according to the cancellation method provided by Barklen. Cancellation generally prevents future renewal but does not automatically refund charges already paid unless required by law or expressly stated otherwise.

12. Refunds

Refund policies for Barklen subscriptions, Featured Placement, Academy products, or other Barklen services will be disclosed at purchase where applicable.

Refunds relating to dog-training services purchased from an independent training business are generally governed by that business's policies.

Barklen is not responsible for a trainer's failure to provide a refund unless Barklen expressly assumes that responsibility.

13. Dog Training Business Academy by Barklen

Barklen may provide:

• Courses
• Webinars
• Workshops
• Templates
• Educational materials
• Business resources
• Coaching or group education

Academy content is provided for educational and informational purposes. Barklen does not guarantee revenue, profit, customer acquisition, business growth, specific financial results, or successful implementation. Business decisions involve risk. Academy content is not legal, accounting, tax, financial, insurance, veterinary, or other regulated professional advice. Users should obtain appropriate professional advice for their circumstances.

14. Communities and Mastermind Groups

Barklen may operate professional communities, including Dog Training Business Mastermind.

Participants must behave professionally and may not:

• Harass others
• Spam members
• Misrepresent themselves
• Publish unlawful content
• Share confidential information without permission
• Use the community for fraudulent or abusive purposes

Barklen may remove posts or members at its reasonable discretion. Communities hosted on third-party services such as Facebook are also subject to the applicable third party's terms.

15. Barklen Newsletters and Research

Barklen may publish:

• Newsletters
• Research
• Industry reports
• Pricing analyses
• Market observations
• Business benchmarks

Unless expressly stated otherwise, this information is informational and does not constitute a guarantee regarding any particular business. Aggregated statistics may be based on available Barklen or public data and may not represent every business in the market.

16. Barklen Video Interviews

Barklen may invite selected businesses to participate in Barklen Video Interviews.

Participation is:

• Voluntary
• Invitation-only
• Subject to Barklen approval

Participation does not guarantee publication, Featured Placement, endorsement, or any other benefit. Video Interview participants may be required to accept a separate media release or consent agreement governing recording, editing, transcription, publication, distribution, and promotional use. The separate release will control if it conflicts with these Terms regarding interview media.

17. User Content

You may provide:

• Text
• Photographs
• Videos
• Reviews
• Business descriptions
• Program information
• Training materials
• Comments
• Other content

You retain ownership of your content. By submitting content for publication or use through Barklen, you grant Barklen a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, distribute, and otherwise use the content as reasonably necessary to provide, promote, and operate Barklen. You represent that you have the rights necessary to provide the content.

18. Barklen Intellectual Property

Barklen and its licensors retain all rights in Barklen's:

• Name
• Logos
• Website
• Software
• User interfaces
• Databases
• Designs
• Research
• Educational materials
• Written content
• Graphics
• Technology
• Other proprietary materials

Except as expressly authorized, Barklen content may not be copied, resold, reverse engineered, distributed, or commercially exploited.

19. Feedback

If you voluntarily provide suggestions, product ideas, feature requests, or other feedback, Barklen may use that feedback without restriction or compensation to you.

This does not give Barklen ownership of your confidential business data.

20. Acceptable Use

You may not use Barklen to:

• Violate law
• Commit fraud
• Harass others
• Scrape Barklen at scale without permission
• Attempt unauthorized access
• Interfere with Barklen infrastructure
• Distribute malware
• Circumvent security
• Impersonate another person or business
• Manipulate reviews
• Submit fraudulent inquiries
• Misuse payment systems
• Send unlawful marketing communications
• Use Barklen to violate privacy rights
• Resell Barklen services without authorization

21. Communications Tools

Businesses using Barklen email, SMS, or communication functionality are responsible for ensuring their communications comply with applicable law.

This includes obtaining legally required consent for marketing communications.

Barklen may impose technical or usage limitations intended to protect users and the platform.

22. Third-Party Services and Integrations

Barklen may integrate with third-party services such as:

• Stripe
• Email providers
• SMS providers
• Calendar providers
• Analytics platforms
• Authentication providers
• Community platforms

Use of those services may be subject to separate terms. Barklen is not responsible for third-party services outside Barklen's reasonable control.

23. Marketplace Transactions and Trainer Responsibility

Dog owners are responsible for evaluating a trainer before purchasing services.

Dog-training businesses are solely responsible for the services they provide.

Barklen does not guarantee:

• Trainer qualifications
• Specific training outcomes
• Safety
• Availability
• Pricing accuracy after information changes
• Compatibility between a trainer and a particular dog
• Statements made independently by a business

Barklen may provide information intended to help consumers make informed decisions, but consumers must exercise their own judgment.

24. No Veterinary or Professional Animal Advice

Barklen does not provide veterinary advice.

Information on Barklen should not replace appropriate advice from a licensed veterinarian or other qualified professional where needed.

25. Service Availability

Barklen works to provide reliable services but does not guarantee uninterrupted operation.

Services may occasionally be unavailable due to:

• Maintenance
• Software changes
• Network failures
• Third-party outages
• Security incidents
• Events beyond Barklen's reasonable control

26. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARKLEN SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

BARKLEN DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nothing in these Terms excludes warranties that cannot legally be excluded.

27. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARKLEN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL ARISING FROM USE OF BARKLEN.

BARKLEN IS NOT RESPONSIBLE FOR INJURY, LOSS, PROPERTY DAMAGE, ANIMAL INJURY, OR OTHER DAMAGE CAUSED BY AN INDEPENDENT DOG-TRAINING BUSINESS OR CUSTOMER.

BARKLEN'S AGGREGATE LIABILITY ARISING FROM PAID BARKLEN SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID BARKLEN FOR THE RELEVANT SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, EXCEPT WHERE APPLICABLE LAW REQUIRES OTHERWISE.

28. Indemnification

To the extent permitted by law, business users agree to defend, indemnify, and hold harmless Barklen and its affiliates, officers, directors, employees, and agents from third-party claims arising from:

• Services the business provides
• Content supplied by the business
• Violation of these Terms
• Violation of law
• Customer disputes
• Misuse of Barklen
• Failure to obtain required rights or consent

29. Suspension and Termination

Barklen may suspend or terminate access when reasonably necessary because of:

• Nonpayment
• Fraud
• Security concerns
• Illegal activity
• Serious or repeated violations of these Terms
• Risk to users or Barklen
• Abuse of payment functionality

Users may discontinue Barklen services according to their applicable subscription terms. Certain provisions that by their nature should survive termination will continue after termination.

30. Changes to Barklen

Barklen is an evolving platform.

We may add, remove, change, or improve features.

We may also modify these Terms.

If a change materially affects your rights, we will provide notice where required.

Continued use following the effective date of updated Terms constitutes acceptance to the extent permitted by law.

31. Governing Law and Disputes

These Terms are governed by the laws of the state in which Barklen principally operates, without regard to conflict-of-law principles.

Any court proceedings will be brought in courts of competent jurisdiction in that state, unless applicable law requires otherwise.

32. Miscellaneous

If part of these Terms is found unenforceable, the remaining provisions remain in effect.

Failure to enforce a provision does not waive Barklen's right to enforce it later.

You may not transfer your Barklen account or rights under these Terms without Barklen's consent.

Barklen may transfer these Terms as part of a merger, acquisition, reorganization, or sale of assets.

These Terms, together with applicable policies and purchase terms, constitute the agreement governing your use of Barklen.
